Oklahoma Prisons – Department of Corrections

Oklahoma prisons made headlines in 2015 and 2016 because of capital cases reaching the United States Supreme Court.

In Glossip v. Grosse (decided 2015), a group of death row inmates filed a suit against the state claiming that their use of midazolam violated the 8th Amendment. The court ruled against the petitioners stating that they failed to prove that the sedative would cause needless pain during the executions.

Bosse v. Oklahoma was decided on October 11, 2016 in favor of the plaintiff. At issue in that case was whether the state had overreached their authority by allowing family members of the victim to testify during the sentencing phase. In delivering the decision, the Court reminded the state that the 1987 decision in Booth v. Maryland had not changed. State of Oklahoma prosecutors picked up on a minor aspect related to that case as presented in the 1991 decision in Payne v. TennesseeThe justices indicated by the ruling that the state had misinterpreted Payne v. Tennessee as it relates to Booth. Because of this ruling, Oklahoma may face a rash of new appeals dating to the 1990s.

Oklahoma Department of Corrections

According to the Bureau of Justice Statistics, Oklahoma prisons housed 28,547 inmates in 2015. These prisoners were comprised of 25,489 male inmates and 3,058 female. These figures amount to a growth in the overall Oklahoma prison population of 3.2% over 2014. Noteworthy is that the Department of Corrections only saw a 2.8% increase in the male prison population while the number of female inmates grew by 7.3% over the previous year.
